What the EEOC Can Do

The EEOC is an independent federal agency that fights workplace harassment and discrimination in a number of ways, including:

  • Conducting training on employment discrimination laws

  • Investigates Charges of Discrimination against employers

  • Initiates lawsuits against employers found to be discriminating

  • Offers free mediation and ADR (alternative dispute resolution) to Charging Employees

In some cases, an EEOC investigator may visit your workplace, speak with other employees, or ask the company to provide written information.


The EEOC Process

From there, the EEOC will assign you an investigator and request evidence from both you and the employer. This information will be analyzed and used to determine whether discrimination has taken place and whether the law was violated.

This information can range from a Position Statement and Office Policies to Witness Statements and written communications. Once they review the evidence of your claim, the EEOC investigator will determine whether there is reasonable cause to believe that discrimination occurred. If the EEOC does not make a determine in your favor it is important to consult with an attorney to understand what your rights are and whether the matter is worth pursuing in Court.


The EEOC’s Emphasis on Mediation

If the EEOC’s investigation determines that there was not enough evidence to show discrimination occurred, the EEOC will issue a Notice of Right to Sue which a short deadline to file a lawsuit in Court. If you have received a Notice of Right to Sue, you must consult an attorney immediately.
