Reasonable Accommodations and the ADA

What is a Reasonable Accommodation?

A reasonable accommodation is any adjustment to an employee's office space, duties, or schedule. Employers must provide reasonable accommodations to employees with a disability to assist them in performing their job duties.  Common reasonable accommodations include a modified schedule, remote work, and access to resources such as a standing desk or speech-to-text technology.

What Are Your Rights?

The Americans with Disabilities Act (ADA) mandates that private sector employers with a workforce of 15 or more individuals must offer reasonable accommodations to employees with disabilities. Additionally, employees who are pregnant or have medical conditions related to pregnancy or childbirth may also qualify for reasonable accommodations. It is the responsibility of the employer to engage in an interactive process to determine the necessary accommodations for employees with disabilities.

Moreover, employers are prohibited from retaliating against employees who request reasonable accommodations. Should an employer fail to provide the required accommodations or engage in retaliatory actions against an employee for making such requests, the affected employee may be entitled to seek damages.
